Agreement to Terms

By accessing this website or purchasing any service from RGV Performance Marketing ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use this site or our services. These Terms apply to all visitors, clients, and anyone who accesses or uses our website or services.

Services Provided

RGV Performance Marketing provides digital marketing services including but not limited to: website design and development, local SEO, paid advertising management (Google Ads, Meta Ads), CRM setup and automation, lead management, review generation, and related marketing consulting services for small businesses in the Rio Grande Valley and surrounding areas.

Payments & Activation Fees

All monthly service plans require a one-time activation fee of $399 due at the time of signup. This fee covers account setup, CRM configuration, onboarding, and initial campaign buildout. Monthly fees are billed on a recurring basis beginning on the date of activation. Payments are processed securely through Stripe. All fees are in U.S. dollars.

Website design and build services are billed separately from monthly retainer plans. Build fees range from $250 to $750 depending on scope and are due prior to or upon project completion as agreed in writing. A monthly maintenance fee of $69 applies to websites we host and maintain on your behalf.

Cancellation & Refunds

Monthly service plans are billed month-to-month with no long-term contract required. You may cancel at any time by notifying us in writing with at least 7 days' notice before your next billing date. Cancellations take effect at the end of the current billing period — you will retain access to services through that date. Activation fees and completed setup work are non-refundable. Monthly fees already paid are non-refundable but will not be charged again after cancellation is confirmed.

Website build fees are non-refundable once design work has commenced. If a project is cancelled before work begins, a full refund may be issued at our discretion.

Client Responsibilities

You agree to provide accurate information about your business, respond to reasonable requests for approvals or content in a timely manner, and maintain any third-party accounts (Google, Meta, etc.) required to deliver services. Campaign performance depends in part on factors outside our control, including ad platform algorithms, market conditions, and your business's ability to follow up with leads. We do not guarantee specific lead volume or revenue outcomes.

Intellectual Property

Upon full payment, you own all website designs, landing pages, and custom content we create for your business. We retain the right to display your project in our portfolio unless you request otherwise in writing. Any tools, templates, automations, or proprietary systems we use to deliver services remain the property of RGV Performance Marketing.

Limitation of Liability

RGV Performance Marketing shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or this website. Our total liability to you for any claim arising from our services shall not exceed the total amount paid by you to us in the three months preceding the claim. We are not responsible for changes made to your accounts by third-party platforms (Google, Meta, Stripe, etc.) or for platform policy changes that affect campaign delivery.

Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes arising from these Terms or our services shall be resolved in the courts of Cameron County, Texas, or through binding arbitration at our election.

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. We will update the "Last updated" date at the top of this page when changes are made.
